1. Acceptance of Terms

By downloading, installing, or using Daily Check-In Coach ("the app", "our service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the app.

These Terms constitute a legally binding agreement between you and Daily Check-In Coach. Please read them carefully before using our service.

2. Description of Service

Daily Check-In Coach is a voice-first wellness coaching application that provides:

• Five types of daily check-ins (Shadow Work, Day Planning, End of Day, Friday Deep Decompression, Weekend Reset)
• Voice recording and AI-powered transcription
• AI-generated coaching responses and guidance
• 5-minute actionable tasks based on your check-ins
• Weekly review summaries
• Streak tracking and progress monitoring

3. Eligibility

You must be at least 16 years of age to use the app. By using Daily Check-In Coach, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian to use the app.

4. Accounts & Registration

To use the app, you must create an account using either an email address and password or Apple Sign-In. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions & Payments

Daily Check-In Coach offers the following auto-renewable subscription options:

• Daily Coach Monthly: A 1-month auto-renewable subscription providing full access to all features.
• Daily Coach Yearly: A 12-month auto-renewable subscription providing full access to all features at a discounted rate.

Subscription details:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
• You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

6. Free Trial

New subscribers may be eligible for a 3-day free trial. The free trial provides full access to all premium features. If you do not cancel before the end of the free trial period, your subscription will automatically convert to a paid subscription at the rate of your selected plan.

Free trial eligibility is determined by Apple and is typically available once per Apple ID.

7. Cancellation & Refunds

• You may cancel your subscription at any time through your Apple ID account settings.
• Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period.
• No partial refunds are provided for unused portions of a subscription period.
• Refund requests must be directed to Apple through the App Store, as payments are processed entirely by Apple.

8. User Content & Voice Recordings

When you use the app, you may provide content through voice recordings and text input ("User Content"). You retain ownership of your User Content. By using the app, you grant us a limited licence to process your User Content solely for the purpose of providing the service, including:

• Transcribing your voice recordings using AI speech-to-text services
• Analysing your check-in content to generate coaching responses
• Creating weekly review summaries from your check-in history

Voice recordings are processed in memory and are not permanently stored on our servers. Only text transcriptions are retained. For full details on how we handle your data, please see our Privacy Policy.

9. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to gain unauthorised access to our systems or other users' accounts
• Interfere with or disrupt the operation of the app
• Reverse-engineer, decompile, or disassemble any part of the app
• Use the app to transmit harmful, abusive, or objectionable content
• Circumvent any access controls or usage limits
• Share your account credentials with others

10. Intellectual Property

The app, including its design, code, features, AI-generated content, and branding, is owned by Daily Check-In Coach and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the app for personal, non-commercial purposes in accordance with these Terms.

AI-generated coaching responses are provided for your personal use. You may not reproduce, distribute, or commercially exploit the coaching content generated by the app.

11. Disclaimers

The app is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The app will be uninterrupted, error-free, or free of harmful components
• The AI-generated responses will be accurate, complete, or appropriate for your specific situation
• The app will meet your specific requirements or expectations
• Any errors in the app will be corrected

12. Limitation of Liability

To the maximum extent permitted by applicable law, Daily Check-In Coach shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or emotional distress, arising from:

• Your use of or inability to use the app
• Any content or coaching responses generated by the AI
• Unauthorised access to or alteration of your data
• Any third-party services used in connection with the app

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid for the app in the 12 months preceding the claim.

13. Termination

We may suspend or terminate your access to the app at any time if you violate these Terms. Upon termination:

• Your right to use the app will immediately cease
• We may delete your account and associated data in accordance with our Privacy Policy
• Provisions relating to intellectual property, disclaimers, limitation of liability, and governing law will survive termination

You may terminate your account at any time by deleting your account through the app's Profile screen or by contacting us.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the app after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the app shall be resolved in the courts of South Africa.
